ICWA Webinar Series: Notice & Inquiry
This 90-minute webinar details the processes of notice and inquiry required by the Indian Child Welfare Act. Participants will learn the actions and processes required to provide an adequate inquiry and formal notice, as well as the consequences of inadequate inquiry and notice.
After attending this webinar, participants will be able to:
• Understand the difference between inquiry and formal notice processes.
• Determine when inquiry should occur during a case and how to ensure an adequate inquiry is conducted.
• Understand who should be consulted to conduct an adequate inquiry.
• Understand how to provide formal notice under ICWA.
• Distinguish between situations in which there is “reason to believe” and “reason to know” a child is an Indian child as defined under ICWA.
• Continue appropriate inquiry throughout the life of a case.
• Appreciate how appropriate inquiry and notice ensure that a Tribe can have a voice and participate in foster care and adoption cases involving an Indian child from the Tribe.
