Right to State Hearings
If the relative legal guardian has a disagreement about the amount of a Kin-GAP payment/benefits, or if due to a decrease in Kin-GAP payment, they have a right to a state hearing.
The public agency or tribal agency will send a Notice of Action (NOA), which will state why the request for a higher Kin-GAP payment was denied or the reason the Kin-GAP payment is being reduced.
The Notice of Action explains how to request a state hearing. The legal guardian may request a state hearing by sending a letter to one of the three places:
- In-Person: To the county welfare department at the address shown on the Notice of Action.
- Mail: To the California Department of Social Services, State Hearings Division, P.O. Box 944243, Mail Station 21-37, Sacramento, California 94244-2430.

- Fax: To the State Hearings Division at fax number (833) 281-0905.
