Undue Influence: What APS Needs to Know (eLearning)

Many APS professionals encounter clients who appear to have been manipulated into giving away assets or agreeing to harmful financial decisions. Undue influence is often a gradual process rather than a single event, making it difficult to identify, investigate and document. This course explores the nature of undue influence, common tactics used by influencers, how consent and decision-making capacity factor into these cases, and strategies for investigation and documentation. Participants will also learn how collaboration with other systems and agencies can help reduce client risk and mitigate the effects of undue influence.

After attending this training, participants will be able to:

  • Define undue influence through psychological and legal perspectives

  • Describe the role of decision-making ability in undue influence cases

  • Discuss the relationship between consent and undue influence

  • Identify the four elements a California judge must consider when determining whether undue influence has occurred

  • Explain investigative steps to take in an undue influence investigation
